By accessing or using ProfitTrackStar (the "App") at www.ProfitTrackStar.com or through any associated application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and ProfitTrackStar ("we," "us," or "our").
ProfitTrackStar is a business management application designed to help craft sellers calculate pricing, manage orders, track inventory, and analyze their business performance. The App operates primarily on a local-first basis, storing data on your device.
We reserve the right to modify, suspend, or discontinue any aspect of the App at any time. We will provide reasonable notice of significant changes when possible.
You must be at least 18 years of age to use ProfitTrackStar. By using the App, you represent that you are 18 years of age or older and have the legal capacity to enter into these Terms. The App is intended for use in connection with lawful business activities only.
The free version of ProfitTrackStar currently requires no account. If you join our waitlist or create an account for a paid plan, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account at hello@profittrackstar.com.
You agree to use ProfitTrackStar only for lawful purposes and in accordance with these Terms. You agree NOT to:
ProfitTrackStar and all its content, features, and functionality — including but not limited to the software code, design, user interface, graphics, and text — are owned by ProfitTrackStar and are protected by copyright, trademark, and other intellectual property laws.
You retain all rights to the business data you enter into the App (your products, orders, customer information, etc.). You grant us no rights to that data.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal business purposes in accordance with these Terms.
The free version of ProfitTrackStar is available at no charge subject to usage limits (such as maximum number of products or orders). We reserve the right to modify free tier limits with reasonable notice.
Paid subscription plans (Starter, Pro) are billed monthly or annually as selected at checkout. All fees are in US Dollars and are non-refundable except as required by law or as described below.
If you are not satisfied with your paid subscription, contact us within 14 days of your initial payment at hello@profittrackstar.com and we will issue a full refund. After 14 days, we do not provide refunds for subscription fees already paid.
You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features through the end of your current billing period. After that, your account will revert to the free tier.
We may change subscription prices with at least 30 days notice. Price changes will not affect your current billing period.
Your use of ProfitTrackStar is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The App is designed to store your business data locally on your device. You are responsible for maintaining backups of your data using the Export Backup feature. We are not liable for data loss resulting from browser storage being cleared, device failure, or other events outside our control.
ProfitTrackStar provides pricing calculations, profit estimates, COGS reports, and financial summaries as tools to assist your decision-making. These calculations are based on information you provide and general formulas. They do not constitute financial, tax, legal, or accounting advice.
You are solely responsible for verifying all calculations and for all business and financial decisions you make. We strongly recommend consulting a qualified accountant or financial advisor for tax filings, pricing strategy, and significant financial decisions. We are not liable for any losses, errors, or omissions resulting from reliance on App calculations.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PROFITTRACKSTAR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.
You agree to defend, indemnify, and hold harmless ProfitTrackStar and its owners, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.
These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in Indiana, and you consent to the personal jurisdiction of such courts.
We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page and notify you by email if you have an account with us. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion. Upon termination, your right to use the App ceases immediately. Sections 6, 9, 10, 11, 12, and 13 survive termination.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ProfitTrackStar regarding your use of the App and supersede all prior agreements, representations, and understandings.
